What is the right of pre-emption (RVV)?

The right of pre-emption is a legal right that allows the holder of that right to purchase land and buildings that are sold as priority over the prospective buyer, for the same price and under the same conditions.
The Flemish government and the local authorities (provinces, municipalities, intermunicipal authorities, ...) have a 'right of pre-emption' in certain areas. If a government exercises that right, it acquires the real estate offered instead of the prospective buyer. She then buys at the price and conditions of the prospective buyer.

Why a right of pre-emption?
Rights of pre-emption are an instrument for government institutions to realize their mission of public interest in their fields of activity (such as nature conservation, spatial planning, housing policy, water policy, shipping, etc ...)
In an area where the pre-emption right plays, an owner may only sell after giving the beneficiaries of the pre-emptive right the opportunity to exercise their right.

Where does a pre-emption right now apply?
If you would like to know whether a pre-emption right applies to a certain parcel, you can always consult the maps of Geopunt.

Where can you request an extract about the Flemish pre-emption rights?
All Flemish rights are offered via the e-counter of the Flemish Land Agency (VLM). Stijn Voet Immobiliën has access to this e-counter. We are happy to help you applying your RVV extract.
