  • Can you sell your property if the electricity inspection is negative?
    A negative electricity inspection should not be a stumbling block to sell your home. You must inform the potential buyer about the negative certificate.   • Can you refinance your loan at your own bank?
    You can refinance your credit with your own bank. Therefore you do not have to go to another financial institution.   • Help: a crack in the façade. Can I cancel my purchase?
    If you have already signed the agreement, you are basically stuck with the purchase. You are then actually obliged to cooperate in the execution of the notarial deed. If you do not do this, the seller can claim a compensation or he can force you to continue the purchase anyway.

  • We are going apart. What about the mortgage loan?
    If you live together with your partner and you divorce, one of you can buy the house. For this, a buy-out sum is often paid to the other. How do you determine the purchase price? The current value of the residence is reduced by the amount of the outstanding mortgage loan. This amount once again divided by two if you both owned the property.

  • Buy as an unmarried couple. What do you need to know about 'anticipatory input'?
    Since 1/09/2018 couples who are not married and still buy a property together can have a clause of 'anticipatory contribution' included. With such a clause, the purchased property automatically enters the joint capital if the partners nevertheless marry. A separate marriage contract is no longer necessary for this and you no longer have to go to the notary. Moreover, you also save costs that way.

  • Are smoke detectors mandatory in a rental home?
    The answer to this question is yes. In Flanders, you as a landlord are obliged to place a smoke detector in the home that you let. You must provide a smoke detector per building layer. An example: if you rent a house with three habitable floors, each floor must be equipped with a smoke detector.     As owner of the home you can have a ban on pets included in the contract, but you can not enforce the ban.   • Which identity details can you ask as a landlord to your prospective tenant?
    The name and first name of the prospective tenant may be asked at the first meeting. Asking for an identity card is also a possibility. You may only request a telephone number or e-mail address to contact them at that time, for example to see the property.

    What can not you ask? The national register number and an extract from the criminal record. Furthermore, you may not ask for information about the financial condition or capital situation (ownership of real estate).
